The Fairhaven Acushnet Land Preservation Trust met November 9, 2009 The Fairhaven Acushnet Land Preservation Trust met at 6:30 PM at the Millicent Library on Monday, November 9, 2009. Present were John Darwin, President, Barbara Burr, Secretary, Cindy Haskell, and Ken Lipman. Not present were Carolyn Longworth, Jay Pateakos, Cora Pierce, and Brad Wakeman. Visiting was Heidi Blythe, from the Buzzards Bay Coalition. There was no meeting held in the month of October, and the minutes for the September meeting were not available for approval. Cutting at Shipyard Farm was discussed. A number of mature cedar trees were cut down about four feet from ground level. Ken was first to notice the cutting and investigated the damage with John and Heidi Blythe of the BBC. Heidi documented the cutting in a very well organized photo essay, which she presented to the board. The motive is unknown, except perhaps that a neighbor may have wanted to improve a view. The board discussed possible remedies, and decided that the best approach might be to send a friendly letter to the neighbors designed to let everyone know that alterations are not allowed without permission, and that the board takes notice. Approved– Easement for Viverios Farm. Language about restrictions on archeological work is removed. Technical language referencing Massachusetts General Laws has been added at the request of the lawyer reviewing the CR on behalf of the state. Ken moved to accept the CR as modified. Cindy seconded. All were in favor. Voted in favor of transferring the southern part of Marsh Island to the Coalition for Buzzards Bay. The property transfer is motivated by complications owing to the Radio Tower. At the last meeting with Steve Block of NOAA, it was revealed that the radio group will be making improvements to the towers by laying tons of copper, a biocide, into the proposed saltmarsh. This work will require engineering, which will be done by the proponents of the restoration project. The radio group will not be paying for the required engineering work. Some members of the Trust feel uncomfortable about the appearance that the FALPT is facilitating tax relief, free engineering, and relaxed compliance with environmental requirements for a profit making business. Some members would like to see the Trust extract itself from the complexities of the radio tower by deeding over the parcel to the CBB. The CBB seems to be an ideal partner in the venture, because it supports the marsh restoration project, it has the resources to evaluate the complexities of the environmental impacts of the towers, and the Coalition is more comfortable navigating the ethical aspect of commingling public and private interests. Also, the CBB is far better suited to cope with the responsibility of removing the structure once its useful life has ceased, and it becomes an attractive nuisance. The Trust is united in its desire to give the Southern parcel of Marsh Island to the Buzzards Bay Coalition, and voted accordingly. Surprisingly, the Coalition has asked for ownership of the Northern parcel. The Trust is undecided about how to proceed. Deitlin Woods was discussed. The Trust was informed by Heidi Blythe of the BBC about progress on the road construction. The work is estimated to cost $12,000.00. The Board voted to accept a $1,000 donation earmarked to pay for administrative services. The clerk will work for $8.00 an hour under the supervision of the Secretary, and do whatever the board wishes. It was suggested that she could get the addresses of the neighbors around Shipyard Farm, and send a letter. Also, she can help with mailing out the annual appeal. She could also write a thank you note for money recently received in memory of a land trust supporter. The Board voted to adjourn at 8:00pm. Next meeting is December 8, 6:30 at the Library. At that time the board will attempt to get out the annual appeal, asking for money, and letting members know that the Trust is shifting the annual meeting from fall to spring, in hopes it will attract more participants.

 

The FALPT met August 12, 2009 at the Millicent Library at 6:30pm.  Attending were President John Darwin, Secretary Barbara Burr, Cora Peirce, Carolyn Longworth, and Cindy Haskell.  Not present were Ken Lipman, Jay Pateakos, and Brad Wakeman.

 

The meeting began with a moment of silence to reflect on the passing of David Burke.  David had only attended two meetings before his illness prevented his participation, yet his highest hopes and warmest thoughts were with the Land Trust.  A tree has been donated in his memory.  On a motion duly made and seconded, the board voted to allow the planning of a tree at our Bonney Street property.  Bonney Street is known for its sunset vistas.  The trust discussed the possibility of Bonney Street becoming a place where people could cultivate a bit of earth in memory of a loved one, so long as the planting was natural, and did not call attention to itself.   We’ll see how the tree planting goes in the fall.  ( http://falpt.pbworks.com/browse/#view=ViewAllFiles   Click on Bonney Street to see a photo of the sunset.)

 

At 7:00 o'clock, as publicly advertised, Steve Block,of NOAA made a presentation of the Marsh Island Project along with engineer Craig Wood.  Town residents attended.  Questions about mosquito control and abuse by the public ( trash, off road vehicles, etc..) were raised.  Birders says that they and other lovers of land oftentimes pick up trash.  Regarding concerns about policing the property, the consensus of the meeting seemed to be wait and see, then respond to specific issues specifically.  A gate will be built, but there is no intention at this time to lock it.

 

Craig Wood, engineer for the project, said the radio group refuses to allow the elevated area requested by the Trust.  Wood also said they are planning a substantial investment in the towers by renewing the copper grid.  Block and Wood declined to disclose how much copper would be buried in the land, either by weight, length, or dollar value.  They did show a plan that appears quite extensive.  This was a surprise to the board, which was under the impression that the radio towers were reaching the end of their commercial lifespan and the property was transitioning into passive recreation and wildlife habitat.  Copper is the most common marine anti-fouling agent, and the electric field it creates may impact wildlife.  Wood announced that he would be getting the radio group their permits.

 

The Trust feels a bit baffled about the intentions of the Radio Station group, and advised Steve Block that something needed to be done to clarify rights and responsibilities to remove the impression that the Land Trust is being used as a foil to avoid rent, real estate taxes and obligations of permitting.

 

Steve Block commented rather passionately that a conservation restriction needs to be recorded on the deed for Marsh Island.  He was advised by FALPT board members that a lot of time has been spent on the subject of CR’s.   The board is disappointed that after all the work it has done, the Coalition rejected the terms as offered by Ken Lipman.  Mr Lipman was unable to attend he August 12 meeting.  When he returns, he can advise the board how to proceed.  Presently, the president feels bound to act with h boundaries of he last vote.  At some point the board my vote anew.  At this time however, Steve Block was advised that the subject of conservation easements was not on the agenda, and would not be discussed again tonight.

The Fairhaven Acushnet Land Preservation Trust met Tuesday May 19, 2009 at 6:30 PM at Shaw’s Cove.  Attending were John Darwin, President; Barbara Burr, Secretary; Ken Lipman; and Cora Pierce.  Not present were Cindy Haskell, Carolyn Longworth, Jay Pateakos, and Brad Wakeman.

Heidi Blythe Land Protection Specialist and Brendan Annett Vice President, Watershed Protection, The Coalition for Buzzards Bay, 620 Belleville Avenue, New Bedford , MA 02740, 21 Luscombe Avenue, Woods Hole , MA 02543, Tel. 508-999-6363 x.214    Fax 508-984-7913 attended the meeting to discuss  Conservation Restrictions for the Viverous Farm, Marsh Island, and Deitlin Woods.

Discussion centered on the difficulty of signing a Conservation Restriction when the future of land use is uncertain.  Members wish to be supportive of Coalition goal to protect the health of the Bay, but feel wary of making promises about public access, restrictions of buildings, use of power vehicles, and work in the wetlands, because such promises could forbid desirable uses of the land, such as farming or camping.

Brendan said he would try and draft up something we can approve.  The board is looking forward to reviewing a conservation restriction that can be approved.  Instead of saying – “No work in the wetlands”  the Trust would prefer to see, “all work must comply with Wetlands Protection Act.”  Instead of saying ‘ no buildings, no motorized equipment’, we would prefer to see a promise that any farming will be in accordance with best management practices and approved by the Coalition.

 

 

 

We might like to see some plain language stating goals, ie, “The purpose of this CR is to prevent the land from being developed for residential or industrial purposes.  Farming and recreational uses which are consistent with holding the land as open space shall not be restricted by this CR; and shall be allowed with the scope of the Wetlands Protection Act and other legal parameters.”

Falpt board of directors met February 23, 2009 upstairs in the Library at 6:30 PM Present were Cora Pierce, Cindy Haskell, John Darwin, Ken Lipman, Carolyn Longworth, and Jay Pateakos. Not present were Barbara Burr and Brad Wakeman.

1. Treasurer Reported $14,250.49 on hand in checking account. Board placed David Burke on inactive status and retained Brad Wakeman as Treasurer.

2. John discussed visit to Keith and Sue Santos at Keithʼs Farm. The 20 acres that we lease to Keith will have strawberries, corn, and potatoes this year. After mid July there are many pick your own activities at the farm. People come from the Boston area. Keithʼs farm supports many farm stands on Cape Cod with fresh handpicked produce on a daily basis.

 

3. Steve Block reported about Marsh Island that difficulties with the sewer department, the cemetery and the radio station have cut out an acre of marsh and move the construction date beyond 2010.

 

 

 

4. Abatements from town were denied on Winsegansett Pond. John requested financial relief from the Harbor Trustees

5.Heidi Blythe Land Protection Specialist at the Coalition is asking for ideas on properties at Viveiros, Shipyard, and Dietlin. She will come to next meeting with info about Trustee funds available.

6. Directors and Officers Policy 2 years for $1890.00 one half or $945 due now. A motion to pay this bill passed unanimously.

7. Historical Easement to Acushnet for Whites Factory is derailed. However, Alan Coutinho is working to get it back on track.

8. A visit to 70 Acre Kelleher property in Acushnet led by Ken will take place next Sunday at 10 AM. Meet in the Highlander parking lot just across Main Street

9.  Ken reported that the Community garden committee has not found our land suitable at this time.

 

 

 

10. Ashley Kirkwood a graduate of Fairhaven High and a Student at URI joined the meeting. Ashley is looking for a graduate project and may have found one with Cora Pierce in trail work and access to Nasketucket Woods.

The Fairhaven Acushnet Land Preservation Trust met November 17, 2008 at 6:30 at the Millicent Library.  John Darwin, President, Brad Wakeman, Treasurer, Barbie Burr, Secretary, Cora-Dorothy Peirce, Cindy Haskell, Carolyn Longworth, and David Burke attended.  Ken Lipman and Jay Pateakos were absent.

 

The board set up to assemble a mailing for its annual appeal. 
 
 
Steve Block, NOAA restoration expert, updated the board on progress of the Marsh Island Project.  Money  to purchase Marsh Island was given to the FALPT by the New Bedford Harbor Trustee Council with this project in mind. 
 
 
The site was originally a great rock outcrop, which was quarried for granite.  After the land was chiseled away, the site was filled with dredge spoils from New Bedford Harbor (Pre WWII, pre PCB).  The project, approximately 3 million dollars, is to remove the fill to a depth just below sea level, in hope that the land will accept local seed available naturally adrift in the harbor.
 
 
The project is exciting because it is one of the largest salt marsh restoration projects. .
 
 
The land trust has lobbied tirelessly for the restoration of the hill on the western side of the island  for two reasons.  First, the cost, neighborhood nuisance, and carbon footprint of trucking offsite all that fill is very unattractive.  They have speculated an eighteen wheeler will roll off the site every two minutes for several months.  We would prefer to see as much fill as possible remain on the site.
 
 
Second, we want the height restored to that island.  For those who have stood on the bluff at the end of Harding Road and looked down upon the Acushnet River, St Anthonyʼs Church and all those old mill building, no further explanation is needed.  Height is empowering.  Before it was quarried, Marsh Island proably looked a lot like the land at the very end of Harding Road.  As guardians of the land, we ask to see the restoration of Marsh Island include restoration of the height of land.
 
 
Unfortunately, Steve Block is not interested in keeping the fill on the property, even though it means saving millions  in trucking costs.  But we keep asking.
 
 
The board wished Steve well, and promised our support in all his efforts.
 
 
Voted - to accept the treasurerʼs report.  Brad delivered the treasurerʼs report.  New Member David Burke was introduced.  David most generously offered to have his accounting firm, Burke and Lamb, prepare future filings for the Land Trust.  The board acted immediately with heartfelt thanks and a vote to accept the offer.  David and Brad plan to work together to share information about requirements.

Secretary’s minutes for the June meeting were unanimously accepted.

As approved at the June meeting, a letter of support for the purchase of Nasketucket Woodlands was sent to the Buzzards Bay Coalition by John.

Allen Decker sent us a copy of a grant review with details of match donations sent to US Fish and Wildlife referencing Viverios Farm. FALPT gave $400,000 toward the over 3 million dollar match. There was some discussion about the way the Coalition accounts for funds, particularly the assessment of value of conservation restrictions, and the application of that value.

There was discussion about the use of public money for land without public access. The FALPT is aware of sensitivity about how public funds are used, as well as sensitivity about public access to open space.

There was discussion, delight, and celebration about a new brochure, designed by Lori Bates. The board wants to see something similar to what we are using, but with emphasis on reasons to become a member, as well as the need for stewards for our land. There is a suggestion to look at other brochures, and a request for recycled paper.

The board voted unanimously to pay $842.00 for Chubb Liability insurance one year effective Aug 4, 2008, and $86.00 for a post office box rental for one year

The Annual meeting is slated for Saturday, October 4. The board is looking for a location. The board is proposing a photography contest, as a way to enhance public interest in the Land Trust, as well as increase membership. Barbie and Jay will draft a press release for review for the next meeting. Voted $200.00 to start the work.

The Board of Directors met at the Millicent Library on Thursday, June 26, 2008 at 6:30 PM.

Present were John Darwin, President; Barbara Burr, secretary; Ken Lipman, Jay Pateakos, Cora-Dorothy Peirce, and Carolyn Longworth. Not present were Cindy Haskell, Brad Wakeman, and Lori Bates.

The board met briefly in anticipation of the presentation by Steve Block regarding Marsh Island.

The board authorized the President to send a letter of support regarding the acquisition of Nasketucket Woods, a 52 acre parcel.

The board approved a motion to grant the Town of Acushnet an Historical Easement. The CPA application for Whiteʼs Factory for $5,600 has been approved.

The President has received materials regarding the NSTAR land near Fort Phoenix. It appears there is time to think about the project. The board members are encouraged to peruse the maps and photos, and see if there is any interest from the Trust.

The board voted to pay Seguin and Associates $750 for a survey of the Kelleher property.

The Trust has received a base line survey of Shipyard Farm done by Heidi Blythe at CBB for review and approval. The board is encouraged to review the very impressive organization of materials.

The board voted to pay $25.96 to the Town of Fairhaven for taxes owed on Viveiros Farm.

The board voted to pay $30 to renew its membership in Mass Land Trust Coalition.

Meeting was adjourned at 6:50 PM.

Following the FALPT meeting, Steve Block made a presentation about Marsh Island. The plan is to excavate 6-8 feet of dredge spoils deposited in the 1940ʼs across a 14 acre area. No new fill will be brought on site, and some planting will take place. The hope is that the marsh will reseed itself once the fill is removed. Cost of trucking the fill away is projected to be 2.5 million dollars.

The Land Trust showed the group from NOAA a picture of what Marsh Island used to look like, in which the great rock outcrop was featured. The Land Trust has insisted on some kind of replication for the high area of the island. Originally, the Trust wrote NOAA a letter refusing to allow the fill to leave the site, and suggested that a structure be built using the unwanted material. The project slated for 2010 is still evolving. The Board will discuss whatever issues ought to be addressed at the next meeting.

Monday, April 21, 2008

The Fairhaven Acushnet Land Preservation Trust met April 21, 2008 at #17 Shaw’s Cove. Members present were John Darwin, Cora Peirce, Carolyn Longworth, Brad Wakeman, Jay Pateakos, and Barbie Burr. Absent were, Lori Bates, Ken Lipman, and Cindy Haskell.

The board voted to hold the next meeting Monday, May 12, 2008 at 6:30 at #17 Shaw’s Cove.

Secretary’s minutes for the April 21 meeting were unanimously accepted.

With deep regret, fondest wishes, and heartfelt gratitude, the board accepted the resignation of member and past president, Laurel Farinon.

Membership was discussed. Cora announced that she has created a comprehensive membership list using an excel spread sheet. The list ought to be available for review at the next meeting.

On the subject of Whites Factory cover application of CPA funds from Acushnet, Brad Wakeman motioned and Cora Peirce seconded to pay $500 to Sequin Associates for land surveying services.

FALPT has been offered a property on the North side of Harbor View Avenue by George Grant of Gloucester, MA. The land is 11,000 sq ft with a creek running in the middle. It was moved and seconded to send the deed to FALPT attorney Mark Deshais for an opinion.

The board voted to meet next on May 12, 2008 at #17 Shaw’s Cove Road.

Meeting Minutes for FALPT

March 10, 2008

The Fairhaven Acushnet Land Preservation Trust met March 10, 2008 at the Millicent Library. Members present were John Darwin, Ken Lipman, Laurel Farinon, Cindy Haskell, Cora Peirce, and Barbie Burr. Absent were Carolyn Longworth, Lori Bates, Brad Wakeman, and Jay Pateakos.

The board voted to hold the next meeting April 21, 2008 at 6:30 at #17 Shaw’s Cove.

Secretary’s minutes for the January meeting were unanimously accepted.

John reported that the mailing for the annual appeal has raised about $3800.

Everyone is getting the magazine Exchange, and finding it good reading.

Philip DeNormandie bought Nasketucket Woods from Mariner Soccer with the intention of selling it to the Town of Fairhaven as a conservation area. Cora has been involved in the project, and will bring us a map to explain the plan to the board. Lori is working on a flier with Laurel. They are putting out a request for photos. Anyone with land trust photos should send them to Laurel or Laurie. Also, they are considering the benefits of a stand-alone map, which could be made larger and kept current more easily.

Laurel also asked for guidance about the ‘flavor’ of the flier. The board stressed a need to increase membership. Ideas such as bird watching, tours guided by educated naturalists, and even swim events were bantered about as ways to reach out to diverse groups which may like to join in and support the trust. There was a motion and second for $100 for the website, which passed unanimously.

Dietlin Forest was discussed. The Trust has $10,000 budgeted to construct an access road, but it looks as if that will not be enough money. Estimates range between $25,000 and $50,000. Harbor Trustees has set a sum aside, and may be willing to appropriate more if needed. Laurel will get estimates to construct the road, build a keyed gate and create a small parking area. Laurel is continuing to work with Heidi Blythe from the Coalition on this.

Katherine Straus, a junior at Vassar College studying environmental law, was paid $120 by the Board to file forms at the Fairhaven Assessors Office, and develop our stewardship program by creating files for properties on Sconticut Neck. Great job Katherine.

The board directed John to make inquiries about the status of our liability insurance.

The board voted to hold the next meeting March 10, 2008 at 6:30 in the Millicent Library.

Secretarys minutes for the December 10th meeting were unanimously accepted. The secretary reported that Jay Pateakos has accepted the post of Public Relations. Cora Peirce is picking up membership. Lori is working on a flyer with laurel.

Keys were discussed. Keys are needed to access Shipyard Farm, as well as the Keith and Silva properties. The board agreed that any board member wanting a key should have one, and the full collection should be kept somewhere in the Millicent Library. John will work toward that goal with help from Laurel, who will call Maryann Tessier.

Internship was discussed. Katherine Straus, a junior at Vassar College studying environmental law, has been hired by the Board to help file forms at the Fairhaven Assessors Office, and develop our stewardship program. The board has authorized $500 to be paid for work done by Ms. Straus, and additionally, authorized another $500 to be paid if, in the opinion of overseer Barbie Burr, the work is worth continuing.

The Conservation Restriction for Shipyard farm was discussed. The Coalition for Buzzards Bay will receive 30% of any proceeds in the unlikely event the property is taken by eminent domain. Also, the Coalition is requesting a prohibition of any building other than a structure for the purpose of agriculture, less than 5,000 square feet. John has met with Alan Decker and Mark Deshaies, and believes the Trust should grant to the Coalition the CR as drafted. The Board voted unanimously in agreement.

The board received a letter from Acushnet Building Inspector, James Marot asking the board to post a notice on the site informing people about the need for caution. The board agreed action should be taken, and appropriated up to $200 for a sign. This seventeenth century stone mill is of historic significance. Both the Acushnet Fire Department and the DPW have helped the cleanup project.

The board directed the Secretary to make inquiries about the status of our liability insurance.

The board of directors met at the Millicent Library on November 5, 2007.

Present were John Darwin, President, Bradford B. Wakeman, Treasurer, Lori A. Bates, Cora-Dorothy Pierce, Barbara D. Burr, Jay Pateakos, Ken Lipman, Laurell J. Farinon and Carolyn Longworth. Not present was Cindy Haskell.

Barbara D. Burr was elected corporate secretary. The position of treasurer requires further study.

John and Ken agreed to study an access into 70 acres in Acushnet via a new development going in east of main Street across from the Highlander. A con com meeting is on November 14

A sign up list was passed around to directors for a Subscription to the LTA magazine Exchange. This list will also be used in the application for Directors and Officers Insurance.

Voted unanimously to pay $125.00 to Marc DeShaies as reimbursement for recording fees on the Hayward property.

Voted to pay Town Collector $183.92 for tax bill on Hayward property.

Discussed Street discontinuance on Silver Shell Beach Drive. Ken Lipman to investigate. Although the board did not vote the consensus seemed to be that this was an important issue.

Received the Massachusetts Attorney General Certificate for Solicitation.

Voted unanimously to confirm appointment of member Mark Phaneuf as land Steward of White's Factory parcel on Hamlin Street in Acushnet. Mark has volunteered to trim vegetation around the ruin.

An annual meeting of the Fairhaven Acushnet Land Preservation Trust was held October 20, 2007 at Marsh Island Fairhaven, as duly advertised in the local paper.

 

President John Darwin opened the meeting at 10:15 in a shore side grove on the south eastern corner of Marsh Island. On display was a panoramic photo of the North side of Marsh Island as well as a large color coded map of Fairhaven and Acushnet. John described how a large area of saltwater marsh was covered with dredge spoils. The plan is to remove the dredge spoils and to restore the marsh by planting marsh grasses and other indigenous species to make a home for aquatic and avian species that lived here before the whaling era. NOAA restoration expert Steve Block has said that planning work should be available for review in the spring. A construction schedule starting within three years is anticipated. Work will be around the radio towers which could remain a feature for nearly 30 years.

 

Treasurer Brad Wakeman announced that all the state and federal requirements placed on a non-profit 501 3 c corporation have been met. Brad also provided a written income and expense print out covering the last 6 years.

 

Past president Laurell Farinon was recognized for seven extremely productive years as President of the Trust, during which time she shepparded the spending of over 5 million dollars on land preservation.  Laurell was warmly thanked and invited to speak.

 

Laurell described the contributions of long time director Joyce Reynolds, Acushnet CPA leader Geri Frates, and founder Mark Rasmussen all of whom have recently resigned from the FALPT board of directors each citing other commitments and promising continued membership and support of this land preservation trust. Laurell described the recent acquisition of a pristine forest in Freetown contiguous to the headwaters of our Acushnet River and how negotiations are progressing on constructing the access road. She showed on the map how Wayne Hayward's recent donation of Marsh land in little bay was a fit with other FALPT properties as well as Audubon and Fish and Wildlife properties in an area where the Osprey's nest.

 

Geri Frates moved to accept the nominating committee slate of directors to include Laurell Farinon, Brad Wakeman, Cindy Haskell, John Darwin, Cora Pierce, Caroline Longworth, Barbie Burr, Lori Bates, Ken Lipman, and Jay Pateakos. Following a second the motion passed unanimously

 

The meeting adjourned at 10:45 AM with most members staying to socialize around the exhibits and refreshments. Several members toured the inviting landscapes on Marsh Island.

 

The next Board of Directors meeting is set for 6:30 PM Monday November 5 at the Milicent Library.  Business will include the election of a vice chair, and secretary; getting a mailing out; and a general discussion about how the board will define and move toward both short term and long term goals.

President John Darwin opened the meeting at 7:15 PM. The secretary's report of August 13 was read and accepted. The Treasurer's report was also accepted.

Brad volunteered to send out annual meeting notices. The meeting is on Marsh Island at 10 AM October 20, 2007. Steve Block the NOAA restoration specialist has been asked to present the concept of Marsh Island restoration. Enter Marsh Island via Taber Street which runs west off Main Street toward the river. The address for Marsh Island would be number 1 Taber Street.

A board of directors meeting date was set for 6:30 PM on Monday November 5, 2007 at the Fairhaven Millicent Library. Prior to this November meeting Laurell and John will work up a membership mailing to include a letter, a new map, a reply card, a return envelope, and newspaper clippings.

Voted to pay Chubb insurance $51.00 additional. The premium is now $802.00 per year composed of $734 for 2 million in liability insurance and $68 for a 10 thousand limit covering employee theft.

Voted to expend up to $200.00 on annual meeting expenses and up to $500.00 on membership renewal mailings.

The board meeting as the nominating committee voted unanimously on nominations for 2007 – 2008 directors. Standing for FALPT director are Laurell Farinon, Brad Wakeman, Cindy Haskell, John Darwin, Geri Frates, Caroline Longworth, Barbara Burr, Lori Bates, Cora Pierce, Ken Lipman, and Jay Pateakos.

Brad Wakeman, treasurer gave a comprehensive report on FALPT financial which was unanimously endorsed. The secretary's report of the last meeting was approved.

Cindy reported on the recent CPA committee meeting in Fairhaven. The chair indicated to Cindy that applications were closed to FALPT for this funding round.

The next meeting date was set for 7:00 PM September 12 at Shaw's Cove.

The Annual Meeting date was changed to 10:00 Saturday Morning October 20 at Marsh Island at the foot of Taber Street.

Laurell reported on the Dietlin Access road. It is going out for bids this month.

Voted to approve purchase stamps from the post office for $28.00.

Moved to approve membership renewal in the Land Trust Alliance. Motion tabled until after the annual meeting so that each director will get a subscription to “The Exchange” magazine.

The board met at 17 Shaws Cove Fairhaven on Tuesday July 24, 2007 at 7:00 PM. The chair declared a quorum present and opened the scheduled meeting. Present were John, Brad, and Cindy. Not present were Laurell, Mark, Robin, Geri, and Joyce.

The Treasurer, Brad Wakeman reported free cash of over $12,000.00

The next meeting was set for Monday August 13 at 7:00 PM

The Annual meeting was set for Saturday October 13 at 10:00 AM on Marsh Island.

A briefing on plans for the island and coffee will follow a brief Annual Meeting. Entrance will be at the foot of Taber Street. All are welcome.

John Darwin reported on attending a Fairhaven CONCOM meeting last night with Allen Decker Esq. CBB land protection specialist. The first item was a CR on the waterside portion of the Douglas land to the South of Shipyard Farm, which was purchased by CBB on a sale of low value from Mr. and Mrs. Douglas. The second item was a CR on waterfront at Pope Beach given at no charge to FALPT by The Town of Fairhaven Conservation Commission. Both conservation restrictions were approved unanimously and now go to the Fairhaven Board of Selectmen.

Dietlin Property: Unanimously voted to make Laurell the board representative on the access road construction project. Unanimously voted to reimburse Beverly Dietlin for closing details $178.79 as recommended by Laurell.

Unanimously voted to allow president John Darwin to provide locations on FALPT lands for emergency use by the Town of Fairhaven. John will meet with Bill Fitzgerald, Superintendent of Public Works to finalize locations and restrictions and report back to the board.

Cindy Haskell volunteered to review the draft of the Community Preservation Act for the Town of Fairhaven. FALPT has been invited to attend a public hearing in the Fairhaven Town hall on August 8. Cindy and John Darwin expect to attend.

Voted unanimously to pay legal bill of $ 87.75.

Voted unanimously to pay annual dues of $30.00 to MLTC the Massachusetts Land Trust Coalition.

Voted to approve the Acushnet Historical Commission to work on enhancement of the historical features of our White’s Factory site in Acushnet.

 

Voted unanimously to pay $84.00 for one year of Post Office Box Rent.

 

Voted unanimously to reimburse John Darwin $50.00 for one year Premium Web site fee to http://falpt.pbwiki.com/. A password is not needed to read our page.

There will be an election of the board of directors at the October 13th annual meeting.

The nominating committee will nominate at least 4 members as new directors of the Trust for the election at the annual meeting in the fall of 2007. Persons being considered to date are: Ken Lipman, Carolyn Longworth, Page Roth, and Laurie Bates. The annual meeting is currently planned for 10 am Saturday morning October 6 on Marsh Island. Following a brief business meeting will be a presentation of this spectacular FALPT property including maps, future plans and a tour of Marsh Island as it now stands. A motion to continue Chubb liability insurance and acquire additional insurance for Directors and Officers passed unanimously at a price tag of $1651. President John Darwin expects to order this insurance through the Franey Muha agency in Chantilly, Virginia. This is a special land trust policy in a pool coordinated by the Land Trust Alliance for member land trusts.

The sign at Whites Factory on Hamlin Street is a continued embarrassment due to unsightly damage on the lower portion. The board asked John Darwin to either fix the sign or take it down.

The Harbor Trustee Council, as a condition to the Town of Fairhaven receiving funds for the purchase of the Pope Beach property from Marylyn Lopes, required that the Conservation Commission grant a conservation restriction to the Fairhaven Acushnet Land Preservation Trust. Allen Decker ESQ Land Specialist at the Coalition for Buzzards Bay working with town and state agencies has drawn up the CR. At tonight’s meeting the CR was accepted by the FALPT. President John Darwin signed with Notary Laurell Farinon witnessing.

Mark outlined a plan to double protect FALPT lands by granting a series of conservation restrictions to the Coalition for Buzzards Bay. Parcels that already have government restrictions, parcels under an acre, parcels that have issues and parcels with current encroachments will not be included at this time. The coalition is well aware of the costs involved in accepting each CR and may require compensation. This board is committed to permanently protecting our lands and continues to support this complex project that involves state and local governments.

Not present were Robin Shields, and Geri Frates. President Laurell Farinon opened the meeting at 7:15 PM. The minutes from the meeting of April 23 were unanimously accepted. The treasurer reported a balance of approximately $12,000.00 and no outstanding bills.

It was decided not to participate in an “Adopt a Shoreline Program” at this time.

The land donation from Wayne Hayward is still on track.

A unanimous vote reaffirmed this board’s previous decision to add protection on all land trust holdings by granting appropriate conservation restrictions to the Coalition for Buzzards Bay. Mark will expedite this important procedure.

The board accepted Laurel’s letter of resignation as President of the Fairhaven Acushnet Land Preservation Trust and voted John Darwin in as President of The Fairhaven Acushnet Land Preservation Trust.

President Laurell Farinon, Joyce Reynolds, Geri Frates, Robin Shields, and John Darwin were present. Mark Rasmussen, Cindy Haskell, and Brad Wakeman were unable to attend. Unanimously voted to accept the minutes of the February 26, 2007 meeting.

Laurell reported on the closing of the Dietlin property in Acushnet and the Marsh Island south property in Fairhaven. Beverly Dietlin reported that when she was tempted by developers she found strength to stay with saving the land by remembering the FALPT visit to her property and their discussion of how being in her forest was like being in a cathedral. Geri moved to repay $29,844.66 to the coalition for Buzzards Bay. This was money used to keep the deal together while waiting for Harbor Trustee Funds and involved 4 separate loans and some interest. The motion was seconded and passed unanimously.

Voted unanimously to spend up to $100.00 in connection with receiving a gift of 5.83 acres of marshland in the Weeden Road area from Wayne Hayward.

Laurell presented a letter from Jack Terrill, Coordinator, New Bedford Harbor Trustee Council inviting us all to a Round 3 dedication and Partner Recognition event on May 10 at the Fairhaven Town Hall.

A motion passed indicating FALPT interest in acceptance of 13 acres of land known as Winsegansett Pond. The landowner was unable to work with a restoration plan proposed by NOAA’s Steve Block. Following NOAA/ Badwey negotiations, appraisals and offers a price of $175,000 was agreed upon. The scheme is for FALPT to purchase the pond from Louis Badwey with Harbor Trustee funds awarded through their agent NOAA to FALPT. Implicit is the understanding that FALPT will allow cleanup and marsh restoration efforts by NOAA. NOAA does restorations projects using grants from Harbor Trustee Funds.

Discussions then proceeded concerning the future management of the Fairhaven Acushnet Land Preservation Trust. Topics ranged from hiring a full time staff to merging with another land trust. All members agreed on every major point as they searched for the path that would best preserve the FALPT land collection from development pressures while increasing public accessibility. The board distilled the many discussions over the past several months and achieved a consensus that merger was the best solution offered this time. A motion to appoint Brad Wakeman as the board’s representative to forge a most advantageous merger document passed on a vote of 4 for and 0 opposed with Brad Wakeman and Mark Rasmussen abstaining.

One strong candidate for a merger has been found. That land trust will use the next few months to staff their merger requirements as this board reviews Laurel’s report. The next meeting of this board is scheduled for Monday April 23, 2007. Present were Mark Rasmussen, Robin Shields, Cindy Haskell, Joyce Reynolds, Laurell Farinon, and John Darwin, with Brad Wakeman on speakerphone. Geri Frates was not present.

The secretary’s report of May 15 was accepted as presented

Brad presented a detailed Treasurer’s report with a running balance of approximately $10,000.00 after paying the balance of an appraisal fee that has unknown late charges. Brad also noted that we have loans outstanding that are nearly double our balance. However, with completion of this round of Harbor Trustee funding we will pay them down to zero. The report was unanimously accepted.

Unanimously moved to pay Perry, Hicks, Crotty & Deshaies $160.15 for filing fees etc. The board continues to be overwhelmed by the generosity of this law firm in providing FALPT with excellent pro-bono services.

The board expressed an interest in accepting Mariner soccer field land. However, board members require written details prior to further discussions.

The next meeting was set for 7:00 PM Monday July 17, 2006 at the summer office.

Site visit date: Sunday July 16 at 10:00 AM at Whites Family Amusement Center for a potential land donation by Gloria Arruda 328 Northwest Street, Acushnet.

 

LTA Rally 2006 takes place in Nashville October 12 to 15 and all directors are encouraged to attend.

 

The annual meeting was set for September 27 or 28. Mark and John were appointed as a nominating committee.

It was voted to ask Long Built Homes for access to our pine forest from Oliver Street in Shannon Meadows. The letter sent follows this report.

Shannon Meadows was described at our June 19th board meeting as a new very attractive and well-built neighborhood of homes abutting our 19-acre forest in North Fairhaven.

The Fairhaven Acushnet Land Preservation Trust is a private non-government charitable corporation that holds undeveloped land for future generations.

Our deeded access to this woodland is a difficult walk from Deerfield across extensive wetlands.

In the past Rivard Street provided access for volunteers to carry litter out of the pine grove.

The Shannon Meadows neighborhood brings people to the proximity of our beautiful pine grove and begins to provide the need that we have envisioned for all our open space.

This letter is to request that you name The Fairhaven Acushnet Land Preservation Trust on easement rights from a public way to their 19-acre woodland that abuts Shannon Meadows to the North.

We believe that such easements will benefit Shannon Meadows residents in the quality of life afforded by open space by enhancing our ability to manage the forest.

The Board of Directors met at 7:10 PM on May 15, 2006 at the Coalition for Buzzards Bay Offices. Present were Laurell Farinon, President – Brad Wakeman, Treasurer – John Darwin, Secretary – Geri Frates - Cindy Haskell and Mark Rasmussen. Not present were Joyce Reynolds and Robin Shields. The next meeting was scheduled for 7 PM on Monday June 19, 2006 at 17 Shaw’s Cove.

Laurell explained that there were no foreseeable grants to pay for a recent appraisal done in good faith on an East Fairhaven Farm as a first step in a land preservation attempt. The appraisal cost was $8,500. We had paid the appraiser in full by borrowing one half with the balance from our treasury. After determining that there was enough in the treasury Cindy moved to repay the $4,250.00 loan. It was seconded by Gerri and passed unanimously with one abstention. The discussion noted that appraisals have a time value and that this appraisal will have to be updated if negotiations do not soon resume.

A discussion concerning a conservation restriction in the Atlas Tack area did not result in any votes. However, one half of the board spoke against meeting with the Atlas Foundation.

Laurell reported on progress to date with this round of Harbor Trustee funding. The Dietlin property in Northern Acushnet is surveyed and details of access are being worked out. The Acushnet Saw mill property where FALPT is proposed as a CR holder to the Coalition for Buzzards Bay is also proceeding. Marsh Island South is where FALPT limited ownership is being proposed due to the income producing towers on the land. The entire Marsh Island FALPT acquisition is driven by a marsh restoration project proposed by NOAA and the National Marine Fisheries to make visible ecological improvements to the abused harbor. The role of FALPT, as always, is as care takers of the land in perpetuity.

The Viveiros Farm on Sconticut neck is the most complex land preservation in this round of funding. Negotiators have come to this board for votes to save the negotiations on several occasions. Tonight we reaffirmed that this board is willing to put up FALPT land, as collateral, guaranteeing a multimillion-dollar loan that will enable the deal to close before several hundred thousand dollars worth of options expire. This coming Wednesday the president and secretary will attend a private loan organization’s appraisal of FALPT lands. This board is knowingly risking significant current assets to preserve the Viveiros Farm. It is only because this knowledgeable board of directors is dedicated solely to land preservation that such an excellent decision can be made without regard as to who gets credit for the preservation.

Other directors present were Cindy Haskell, Joyce Reynolds, Treasurer Brad Wakeman, and Secretary John Darwin. Directors absent were Mark Rasmussen, Robin Shields, and Geri Frates. The Secretary’s report from January 25 and the Treasurer’s report with a checkbook balance of $10,006.28 were both accepted as presented.

Laurell described a conversation with Steve Block of NOAA concerning a slowdown with the Acushnet River Fish Passage Project. It seems that the plans are being reworked to reduce the massive environmental assault on the banks and wetlands.

Discussed the authorization letter of March 17 from Jack Terrill, Coordinator, for the New Bedford Harbor Trustee Council outlining procedures for moving forward on Dietlin, Acushnet Sawmill, Marsh Island South, and The Viveiros Farm. Following a discussion the board found that the complicated ownership position proposed for Marsh Island South would most likely preclude a purchase by FALPT.

Acushnet CONCOM is hearing about access to our 70-acre forest at 7 PM Mar 22.

Laurell asked John Darwin to represent the board concerning a Fairhaven Conservation Commission Notice of Intent abutters notice on Cottonwood Street.

Brad reported on the East Fairhaven Farm. The owners are not going forward. The owners have determined that they will not go the APR route. There is no doubt that the owners want to preserve the farm and the open space. We remain prepared to help if and when required.

Laurell reported that Mark is working on getting CPA funds for the Viveiros Farm.

Discussions concerning an Atlas Tack Conservation Restriction concluded that based on the information now available it would not be in the best interest of the FALPT to hold the CR.

Laurell described the importance to the Land Trust of the Vision Workshop set for next Tuesday at 6:30 PM. Laurell also announced that she would not run for president at the annual meeting this spring.

Fairhaven Acushnet Land Preservation Trust

President-Laurell Farinon opened a directors meeting at 7:15 PM on January 25, 2006 at the Coalition for Buzzards Bay offices. Other directors present were Treasurer-Brad Wakeman, Secretary-John Darwin, Robin Shields, Joyce Reynolds, and Mark Rasmussen. Directors not present were Cindy Haskell and Geri Frates. Habitat Restoration Specialist- Steve Block from NOAA Restoration Center presented plans for Acushnet River Fish Passage Projects at White’s Factory and Acushnet Sawmill. These projects are being funded by the Harbor Trustee Council as part of a request from the Massachusetts Division of Marine Fisheries. Steve asked us for a letter to show permitting authorities land owner permission to apply for construction permits. A motion was made and seconded to send such a letter. However, a sense of the meeting was to hold off until our next meeting on February 13, 2006 to allow Laurell and Mark to further review the plans.

John Darwin read the December 23, 2006 secretary’s report. With a correction to change APR to CR in paragraph 3 and the addition of a note from Laurell, about the secretary’s misconception of the Dietlin project, the minutes were unanimously accepted. Brad gave a detailed treasurer’s report and noted that 2005 expenses exceeded 2005 revenue. He announced a running balance of $13,888.92. Mark offered that the report should reveal the $9,000.00 loan from the CBB revolving land fund for deposits paid to the Dietlin’s. The report was accepted with the Treasurer’s caution noted about sequential declines in membership revenue.

Brad, Laurell, and Mark all contributed to a report on the East Fairhaven Farm project, as they were involved in a meeting with a majority of the owners. The owners have ruled out a Massachusetts agricultural preservation restriction. A motion to allow the president to pay $4250.00 for one half of the farm appraisal passed unanimously.

Laurell announced that the Harbor Trustees have indicated that all FALPT projects are still going forward. A motion to borrow $10,000.00 from CBB for a deposit to the Dietlin’s in return for extending the closing date until July 30, 2006 passed 5 for and Mark abstaining. Mark spoke on the Viveiros farm project and the obstacles to overcome. In particular the town of Fairhaven CPA committee has yet to announce their organizational structure.

Laurell announced that on December 30, 2005 the Tinkham deed was delivered to Marc Deshaies, who then registered it as the latest land saved from development. Most of this parcel was logged over several years ago for exceptionally wide pine planks needed for construction at Plymouth Plantation. However, an area in the south still has a stand of these giant pines on an island that was inaccessible to the logger’s equipment.

New business discussions involved how to fill, a position best described as, Membership Secretary and progress on meeting the requirements of The LTA Standards and Practices.

The board of directors met on Wednesday December 21, 2005 at the offices of the Coalition for Buzzards Bay. Laurell Farinon called the meeting to order at 7:10 PM.

Other directors present were Mark Rasmussen, Cindy Haskell, Joyce Reynolds, Robin Shields, Brad Wakeman, and John Darwin. Director Geri Frates was absent. The board unanimously approved the minutes of the November meeting. Laurell requested reimbursements for mailing expenses. A motion for the $275.13 amount passed unanimously. There has been little spending activity since our last meeting. However, Laurel did announce that the returns from our combination membership and annual fund mailing have been very encouraging.

Brad reported on negotiations with the East Fairhaven farm working toward preservation through an agricultural protection restriction. There has been little progress since the last meeting. We seem to have a roadblock causing serious delays in the initial filing with the state of Massachusetts. However, Brad explained how the parties are searching for the best way to accomplish the best for everyone involved.

Mark reported on the Viveiros farm on Sconticut Neck. We have one million in federal oil spill funds and a CR agreement signed by Fairhaven Selectmen. We have a signed purchase and sale agreement that needs to be extended until Harbor Trustee Funds are released. A motion was made and seconded to pledge FALPT property at Ship Yard Farms to the Coalition for Buzzards Bay in return for a $510,000.00 loan from the Bay Lands Revolving Fund. This money will be used to buy an extension. The motion passed 6 for and none against with Mark abstaining.

Laurell reported that Howard Tinkham is close to deeding us land in Acushnet bordering on Mattapoisett and Tinkham’s Pond.

Mark reported that a closing on Nulands Neck (formerly Kelleher) would take place before January 1, 2006. This involves a conservation easement on the entire property except for 2 estate lots using about 15 acres of the 105 acres.

There does not seem to be enough money available in this round from the Harbor Trustee Council to protect the Dietlin property at the head of the Acushnet River. It appears that the land trust will lose the option money advanced to Dietlin.

The board voted unanimously to accept a gift from Mary Ann Tessier. The gift is a 1.8-acre portion of a sandy island adjacent to Shipyard Farms.

Laurell writes Jan 25, 2006 Hi John-

I would like to make a correction to the minutes related to the Dietlin project. The Trustee Council had concerns about purchasing a Cranberry Bog CR on 90-acres on the easterly side of Squam Brook (tributary to Acushnet River). They may recommend a modification to the project, however we are not in danger of losing our deposit money. Would you kindly revise the minutes to reflect the change and make copies for distribution tonight.
